David Uitti
Dave is a founding Principal of the firm and Chair of the firm’s Litigation Practice Group. For more than 17 years, Dave has specialized in complex civil litigation at both the trial and appellate levels. Dave’s practice is focused on real estate, condominium/community association, construction and land use matters. Dave’s clients include condominium associations, homeowners associations, cooperative boards, real estate developers, property managers and individuals. Before moving to Massachusetts, Dave was a litigation attorney with Dechert, LLP, one of the top 50 nationally-ranked law firms by the American Lawyer, in his home town of Princeton, NJ.
Dave lives in Duxbury, MA with his family, where he serves as an elected member of Duxbury’s Town Planning Board.
In 2014, Dave was named by Cape Cod & Plymouth Business magazine as one of the top 40 business professionals under 40 years old. The award is given to honor “the region’s top young business leaders who excel in their industry and show dynamic leadership.”
Dave regularly writes and speaks on topics concerning real estate and condominium/community association law.

REPRESENTATIVE MATTERS
Served as co-lead counsel representing a condominium association in Winthrop, MA in a condominium construction defect litigation that resulted in a settlement for the client of over $3,000,000, one of the largest such settlements in Massachusetts.
Served as lead counsel representing multiple condominium associations in construction defect litigations that resulted in seven-figure settlements for clients following mediation.
Following a 7-day jury trial in Superior Court, obtained a verdict for over $700,000 for a condominium association in Easton, MA against a contractor concerning a negligently installed waste water treatment facility.
Following an 11-day arbitration, obtained a judgment for client – including $102,000 in attorney’s fees – against developer/general contractor for costs to correct construction defects in client’s home on Martha’s Vineyard.
Following a 3-day trial in the Land Court, obtained a verdict for client requiring defendant to specifically perform on a contract concerning the conveyance of an interest in a waterfront home on the South Shore.
Obtained a significant six-figure settlement for a condominium association from developer-appointed
former trustee following the second day of jury trial in Superior Court.
Obtained s favorable resolution of a multi-million dollar construction defect action on behalf of clients who developed the condominium.
